Is Humanitarian & Compassionate (H&C) the best first option if I’m out of status?
Not always. H&C is usually considered when all other programs are unrealistic. If there is a plausible family, economic, or refugee pathway, IRCC expects you to use that first. We will only recommend H&C after carefully reviewing all alternatives.
How long do H&C applications take now?
Processing times fluctuate and are affected by reduced admission targets and large backlogs. You should be prepared for a multi-year process and plan your life carefully while you wait. During consultation, we’ll review the latest posted times and realistic expectations.
Can a refusal be fixed by just resubmitting the same documents?
Reapplying with the same weak evidence usually leads to the same refusal. You now often receive more detailed officer notes with many temporary resident refusals. These must be read carefully and addressed directly in any re-application or appeal strategy.
Is claiming refugee protection “easier” than other options?
No. Refugee claims are serious legal processes meant for people who truly face persecution or serious harm. Making a weak or unfounded claim can damage your credibility and limit future options. We will only support claims that clearly align with Canada’s refugee laws.
