In August 2020, Immigration, Refugees and Citizenship Canada (IRCC) introduced temporary measures that allowed TRV holders to apply for employer-specific work permits from within Canada. These measures were extended until February 2023, and they not only allow TRV holders to apply for work permits from within Canada, but they also allow eligible visitors to start working before receiving the work permit.
Visitors in Canada can apply for a work permit and request Interim Authorization to Work if they held a valid work permit in the last 12 months.
If you’re a Temporary Resident Visa (TRV) holder in Canada who is looking to apply for a work permit, you’ll be pleased to know that you can now do so from within the country.
But what exactly is Interim Authorization to Work, and how does it work?
Normally, foreign workers who are in Canada on a TRV cannot change their status without leaving the country. However, due to COVID-19 measures, people can no longer “flagpole,” which is when you leave Canada and return for the purpose of activating a temporary status.
To address this issue, IRCC introduced Interim Authorization to Work. This authorization enables TRV holders who meet the eligibility criteria to begin working while their work permit application is being processed. It is intended to enable those with an employer-specific job offer to begin work immediately and to address labour shortages caused by the prolonged processing time for work permit applications.
So, how do you apply for Interim Authorization to Work?
First, you must be physically present in Canada and have submitted an employer-specific work permit application using the Application to Change Conditions, “Extend my Stay or Remain in Canada as a Worker” [IMM 5710] form.
You must also have stayed in Canada with status since submitting the application, and you must submit the application before February 28, 2023.
Once you have submitted the application, you can request Interim Authorization to Work on the same form.
To be eligible, you must have held a work permit that was valid for 12 months before applying for a new work permit and have applied for an employer-specific work permit between August 24, 2020, and February 28, 2023.
It’s a two-step process to get Interim Authorization to Work:
Step 1:
Request Interim Authorization to Work on the Application to Change Conditions, “Extend my Stay or Remain in Canada as a Worker” [IMM 5710] form.
Step 2:
Submit the form, along with the required documents, to IRCC.
If your request is approved, you will receive a letter of approval and a sticker on your passport, which will allow you to begin working while your work permit application is being processed.
Please note that Interim Authorization to Work is not automatic, and approval is not guaranteed.
